GENERAL TERMS AND CONDITIONS OF SALE - BIO CHEVAL

1. PURPOSE AND IDENTIFICATION

These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between BIO CHEVAL and any person (the "Customer") placing an order on the website https://www.bio-cheval.com/gb/quality-natural-products-for-horses-ponies-and-donkeys.

2. PRODUCTS AND WARNINGS

The products offered for sale are food supplements, care products and accessories for horses and animals.

Important warning:

The products sold by Bio Cheval are not veterinary medicines. The information and advice provided on the site or by customer service are given for information purposes only and in no way replace the opinion, diagnosis or treatment prescribed by a veterinary surgeon. Bio Cheval accepts no responsibility in the event of misuse of the products or failure to observe the precautions for use.

3. PRICES

Prices are quoted in Euros (€), inclusive of all taxes (VAT) and exclusive of delivery costs. Bio Cheval reserves the right to modify its prices at any time. Products will be invoiced on the basis of the prices in force at the time the order is validated. The total amount to be paid (products + delivery costs calculated according to destination) is clearly indicated before the final validation of the order.

4. ORDERING AND PAYMENT

Validation of the order implies acceptance of these GCS.

Means of payment:

Payment is made when the order is placed. The Customer has several secure methods of payment indicated on the site (credit card, etc.). Bio Cheval also offers payment facilities, in particular payment in 2 or 3 instalments free of charge by credit card, subject to the acceptance conditions of our financial partner.

Retention of title:

The products remain the property of Bio Cheval until full payment of the price by the Customer.

5. DELIVERY

Zones and Rates: Bio Cheval ships to France and abroad. Delivery charges and the carriers available vary according to the weight of the order and the delivery address. The exact amount of delivery costs is calculated and displayed in the shopping basket before the final validation of the order by the Customer.

Receipt: In the event of an abnormal delay in dispatch, an e-mail will be sent to the Customer. In the event of a visibly damaged parcel, the Customer is invited to make reservations with the carrier and to contact Bio Cheval as soon as possible.

6. LEGAL RIGHT OF WITHDRAWAL (14 Days)

In accordance with articles L.221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt of the parcel to change his/her mind and return the products.

Legal return conditions: Products must be returned in new, unopened, unused condition and in their original packaging. The Customer must inform Bio Cheval of his decision and return the goods at his own expense (unless otherwise indicated by customer service) to the address of the registered office. Bio Cheval will proceed with the reimbursement of products returned in conformity.

7. EXCLUSIVE COMMERCIAL GUARANTEE: "SATISFIED OR MONEY BACK" (90 Days)

In addition to the legal right, Bio Cheval offers an extended commercial guarantee to enable the Customer to test the effectiveness of the products with complete peace of mind.

Duration:

This guarantee is valid for 90 days from the date of delivery.

How the guarantee works :

1. First item opened: If the Customer is not satisfied after use, the first opened bucket, bottle or unit will be refunded on request, with no obligation to physically return the product.
2. Additional items (batch purchases): If the Customer has ordered several units of the same reference (e.g. a batch of 3 buckets), only the first bucket opened will be refunded without return. To obtain reimbursement for the remainder of the order, the Customer must return the other new and unopened units.

Terms and conditions:

To activate this guarantee, the Customer must contact Customer Services (email or telephone) quoting their order number. Bio Cheval will then indicate the procedure to follow.

8. LEGAL GUARANTEES

Independently of the commercial guarantee, Bio Cheval remains bound by the legal guarantees applicable to all products:

• Legal guarantee of conformity (Art. L.217-3 et seq. of the French Consumer Code): 2 years for defects in conformity existing at the time of delivery.
• Hidden defects guarantee (Art. 1641 et seq. of the French Civil Code): Protection against hidden defects making the product unfit for use.

10. MEDIATION (MEDIAVET)

In the event of an unresolved dispute following a complaint to Bio Cheval, the consumer Customer may refer the matter free of charge to the Consumer Ombudsman:

11. PERSONAL DATA

The data collected is required to manage orders. It is not sold to third parties. Customers have the right to access, rectify and delete their data (RGPD).

12. APPLICABLE LAW AND DISPUTES

These GTC are governed by French law. In the event of a dispute, an amicable solution will be sought as a matter of priority.

• For Consumer Customers: Failing amicable settlement, the competent courts will be determined in accordance with the rules of civil procedure (choice between the consumer's place of residence or the registered office of Bio Cheval).
• For professional customers (B2B): All disputes shall fall within the exclusive jurisdiction of the Commercial Court of Boulogne-sur-Mer, notwithstanding multiple defendants or the introduction of third parties.
